The Day of the Constitution of the Republic of Tajikistan

At the department of propaedeutics of children diseases of SEI «ATSMU» 02.10.22 year an open lesson was held on the topic of «The Day of the Constitution of the Republic of Tajikistan» with the participation of teachers of the department and students of the 5th group of the 2nd year of bachelors (teacher – Kasimova P.V) and 68, 69 groups of the medical faculty. Presentation was prepared by students of group 5th Harendra Tada.

On November 6, 1994, the Constitution of the Republic of Tajikistan was adopted at a national referendum, which played a huge role in the establishment of an independent democratic Tajikistan and ensuring peace on Tajik soil. In honor of this event, a public holiday was established in the country - the Constitution Day of the Republic of Tajikistan, which was officially included in the list of state dates of Tajikistan in 1998. The Constitution in Tajikistan is a fundamental document that defines the foundations of the state system, the procedure for the formation and functioning of the main state bodies of legislative, executive and judicial power, local self-government bodies, the election procedure, as well as the powers of the head of state, the fundamental rights, freedoms and duties of citizens, the procedure for amending to the Constitution and the possibility of its revision.

The main law of the country itself, after its adoption in 1994, was later supplemented and amended three times. This happened in 1999, 2003 and 2016. The Constitution of Tajikistan proclaims the country an independent, socially oriented state, recognizing the main value - human rights and freedoms, defining citizens as the main source of sovereignty. This is confirmed by her last article, which affirms the inviolability and impossibility of changing such foundations of the state as the republican form of government, territorial integrity, legal, secular and social essence of the state.

Chapter ten: Procedure for Amending the Constitution;

The constitution provides for unitarism, strong presidential power, the status of the Tajik language as the state language and Russian as the language of interethnic communication, and the autonomy of the Gorno-Badakhshan region. Amendments can be made by referendum; were introduced in 1999 (establishing a bicameral parliament instead of a unicameral one) and 2003 (extending the term of office of the president). The republican form of government, territorial integrity, democratic, legal, secular and social essence of the state are not subject to change.

In May 2016, amendments were adopted that removed restrictions on the number of re-elections for the presidency from Emomali Rahmon and reduced the age limit for the president from 35 to 30 years.

Celebration

According to the Law of the Republic of Tajikistan "On holidays" (edition of the law № 628 of May 22, 1998), on November 6, the Tajik people celebrate a national holiday - the Day of the Constitution of the Republic of Tajikistan.     

Story. During the existence of the Tajik USR, four constitutions were adopted: in 1929, 1931, 1937 and 1978.

It was adopted by the IV Congress of Soviets of the Republic on February 24, 1931.

 

Constitution of the Tajik USR of 1937

The third constitution was adopted on March 1, 1937 by the Extraordinary 6th Congress of Soviets of the Tajik USR.

Adopted by the Supreme Soviet of the Tajik USR at the eighth session on April 14, 1978.

The constitution consists of 10 chapters and 100 articles

We, the People of Tajikistan, being an integral part of the world community, realizing our duty and our responsibility to past, present and future generations, realizing the need to ensure the sovereignty and development of our state, recognizing unshakable freedom and human rights, respecting the equality and friendship of all nations and nationalities, aiming to create a just society,

 

WE ADOPT AND DECLARATION THE PRESENT CONSTITUTION.

 

                                  CHAPTER FIRST

       FOUNDATIONS OF THE CONSTITUTIONAL ORDER

                             

                                           Article 1

The Republic of Tajikistan is a sovereign democratic legal secular unitary state.

The form of government of the Republic of Tajikistan is presidential.

Tajikistan, being a social state, creates conditions that ensure a decent life and free development of a person. The Republic of Tajikistan and Tajikistan are equivalent concepts.
