The phenomenon of civil service in the Republic of Tajikistan, like other political and legal phenomena, has developed in today's conditions and is in the stage of development depending on the development of public relations. The adoption of the Constitution of the Republic of Tajikistan marked the beginning of the construction of a new state system and created a favorable basis for the gradually improvement of the public administration system and public administration reforms, which plays an important role in the political and legal life of society, especially in the civil service system. State Independence of the Republic of the Tajikistan is the highest achievement in its history, due to this came up some occurrences which their basis strengthened through the Constitution of the Republic of Tajikistan.

Thanks to the State Independence and the wise and fair policy of the President of the Republic of Tajikistan, respected Emomali Rahmon, the historical values of statehood of the Tajik people have been revived and strengthened in the norms of the Constitution of independent Tajikistan . According to Article 27 (2) of the Constitution of the Republic of Tajikistan, equal rights of citizens to public service are guaranteed. This provision for the first time ensured equal rights of citizens to public service at the constitutional level, and admission of citizens to public service on equal general terms is one of the achievements of the independent state of Tajikistan, which demonstrates its democratic and legal nature

Based on the constitutional norms, the Law of the Republic of Tajikistan "On Civil Service" No.233 of March 5^th , 2007 was adopted which defined the organizational and legal bases of civil service, legal status and social guarantees for civil servants of the Republic of Tajikistan. In the Republic of Tajikistan, since the independence of Tajikistan, in accordance with the wise policy of the President of the Republic of Tajikistan, Honorable Emomali Rahmon, more attention was paid to increasing the influence of the civil service sphere than to other spheres. In this regard, one of the measures in the civil service system is the regulation of official and unofficial behavior of civil servants, etiquette and influence of civil service. Article 1 of the Law of the Republic of Tajikistan "On Public Service" of March 5, 2007, No. 233, explains the concept of "ethics of a public servant" as follows:

- ethics of the civil servant - set of norms, principles and rules of office and out-of-office behavior of the civil servant, which embodies the ethical features of professional activity and his behavior in work and society, includes the generally recognized values of human morality, the moral requirements of society to the civil servant.

Public service, as an integral part of the state structure, plays a liaison role between the state and society; it is entrusted with the provision of social and legal guarantees for citizens as defined by the Constitution of the Republic of Tajikistan. The main duty of civil servants of the Republic of Tajikistan is not only to serve the state but also to assist the state in serving the society. Public service should contribute to the implementation of national priorities and purposeful activity of state bodies.

It should be noted that the Code of Conduct of Civil Servants of the Republic of Tajikistan operates in the Republic of Tajikistan. The present Code is adopted with a view to increasing the influence of public service, strengthening the responsibility of public servants and the effectiveness of public service management, as well as strengthening the reputation of the institution of public service, regulation of conflicting interests, as well as to explain the principles of public service. The Code of Ethics of a Civil Servant of the Republic of Tajikistan embodies the ethical nature of the professional activity of a civil servant of the central and local executive bodies of state power and bodies of self-government of cities and villages of the Republic of Tajikistan. The Code of Ethics of the Civil Servant of the Republic of Tajikistan is based on the normative legal acts of the Republic of Tajikistan, recognized values of human morality and moral requirements of society to civil service.

As stated above, the Code of Conduct of civil servants of the Republic of Tajikistan is in force in the Republic of Tajikistan. This Code embodies the ethical nature of the professional activity of civil servants of the central and local executive bodies of state power and bodies of self-government of cities and villages of the Republic of Tajikistan.

This Code is based on the principles of civil service and requirements for the conduct of civil servants, which are stipulated by the laws of the Republic of Tajikistan "On Civil Service" and "On Combating Corruption", as well as the following principles of civil service ethics

- legality;

- observance and protection of human rights;

- honesty;

- tolerance.

It should be noted that the experience of state-building and governance is a model system of Public administration, formation and development of lawmaking and law enforcement, observance of human rights and social justice are rare achievements in the history of Tajik statehood, which evolved and developed at different stages and have persisted to this day. In connection with the emphasis of the President of the Republic of Tajikistan, the respected Emomali Rahmon, civil servants should work with "clean hands and heart", "good intentions", "loyalty to their state and nation", "patriotism", "sense of responsibility". These should form the basis for the daily activities of civil servants of the Republic of Tajikistan. Real and effective implementation of these words will contribute to ensuring the rule of law, protection and realization of the rights and freedoms of man and citizen, conscientious activity, respect and proper treatment of citizens.
